1. Nature of Society Membership & Charges
South Baridhara Society is a residential community where property owners are members. This portal facilitates the management of society obligations:
- Property Owner Membership: Membership is for legal property owners within South Baridhara Society boundaries.
- Monthly Maintenance Charges: These are fees for shared society services (security, maintenance, utilities, administration) that benefit all members.
- Not a Commercial Transaction: Payments are contributions toward shared society expenses, not purchases of goods or services.
2. Monthly Maintenance Charges - Non-Refundable
All monthly maintenance charges paid through this portal or at the society office are non-refundable. This policy applies to:
- Regular monthly maintenance charges
- Advance payments for future months
- Any additional charges, fees, or levies approved by the Executive Committee
- Penalty charges for late payments
- Special assessment charges for major repairs or improvements
- Property sale or ownership transfer
- Member relocation or change of residence
- Property remaining vacant or unoccupied
- Disagreement with society decisions or management
- Temporary absence from the property
- Change in property usage (residential to commercial or vice versa)
- Any personal or financial hardship
3. Why Charges Are Non-Refundable
Monthly maintenance charges fund the continuous, ongoing operations and maintenance of the society that benefit all members collectively. These expenses are incurred regardless of individual member circumstances:
- Security Services: 24/7 security personnel, CCTV monitoring, gate management
- Common Area Maintenance: Roads, drainage, street lighting, landscaping, parks, walkways
- Utilities: Water supply pumps, electricity for common areas, waste management
- Community Facilities: Mosque, school, playground, community center maintenance
- Administrative Operations: Office staff, accounting, legal, audit, insurance
- Reserve Fund: Major repairs, infrastructure upgrades, emergency contingency
- Compliance: Regulatory fees, taxes, statutory requirements
The society operates on a collective funding model where all members contribute to shared costs that are incurred continuously. Expenses do not stop when an individual member's circumstances change.
4. Payment Errors and Duplicate Payments
In the rare event of a verified technical error resulting in duplicate charges or incorrect amounts:
- Members must report the issue to the society office in writing within 7 business days of the transaction date.
- The society management (Treasurer & General Secretary) will investigate and verify the error.
- If a genuine duplicate payment or system error is confirmed, the excess amount will be adjusted against future monthly maintenance charges (not refunded as cash or bank transfer).
- All adjustments require written approval from both the Treasurer and General Secretary.
- The member will receive written confirmation of the adjustment applied to their account.
5. Property Sale or Ownership Transfer
When a property is sold or ownership is transferred within South Baridhara Society:
- Outgoing Owner's Responsibility: The seller remains responsible for all charges up to the official transfer date recorded by the society.
- No Refund of Advance Payments: Any advance payments made by the outgoing owner cannot be refunded as cash.
- Transfer of Credit Balance: Upon written request and Executive Committee approval, any advance payment credit may be transferred to the new owner's account.
- New Owner's Responsibility: The buyer assumes responsibility for all future monthly charges from the transfer date.
- Formal Process: A formal transfer application with supporting documents (deed, mutation, ID) must be submitted to the society office.
- Clearance Certificate: The society issues a dues clearance certificate only after all outstanding amounts are settled.
6. Dispute Resolution
If a member has concerns regarding charges, payments, or this policy:
- Submit a written complaint to the Society Office addressed to the Treasurer or General Secretary.
- The Executive Committee will review the complaint at their next scheduled meeting.
- The Committee will respond in writing within 15 business days.
- The Executive Committee's decision is final and binding per society bylaws.
- Members retain the right to raise concerns at the Annual General Meeting (AGM).
